Summary: The work seeks to demonstrate how the enactment of the National Water Resources Policy (PNRH) built in an environment of deregulation of the economy, a requirement of the financialization process, leads to an emptying of the functions of the State, passing through such a policy to adopt the economic instruments as the main management mechanism and make the market its regulatory body. The aim is, therefore, to highlight the crisis of the capitalist mode of production in the promotion of this environment, which has as its particular characteristic the flight of capital from the productive sphere to the
sphere of speculation. This process, under the influence of technological advances, intensifies ecological exploitation through the creation of products derived from water use rights. The work highlights the tendency of this movement to seek an exacerbated appropriation of natural resources through the sale of securities in the Futures markets, focusing on the access of traditional peoples and communities to such resources. To do so, an analysis of data that some government entities presented during the territorialization stage of the Doce river basin is used here, already perceiving in this
an institutional arrangement created, between the public and the private, about a new denomination of water governance, for an effective implementation of processes that legitimize mechanisms that configure water as an element of capital appreciation.
